Welcome to JustTheCardGuy.

These Terms of Service ("Terms") apply to your use of justthecardguy.com and to purchases made from JustTheCardGuy. The terms "we", "us" and "our" refer to JustTheCardGuy, operated under the trading name JustTheCardGuy Creative.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services to you.

These Terms describe the rights and responsibilities that apply when you visit our website, use our Services or place an order with us. They should be read together with our:

By accessing or using our website or placing an order, you agree to these Terms to the extent permitted by applicable law.

Nothing in these Terms limits or excludes any mandatory rights that you have under applicable consumer law.


SECTION 1 — ACCESS AND ACCOUNTS

You may use our website only for lawful purposes.

If you create a customer account, you are responsible for providing accurate and up-to-date information and for maintaining the confidentiality and security of your login credentials.

You are responsible for activity carried out through your account unless the activity occurred without your authorisation.

If you are under the age required to enter into a legally binding purchase agreement in your country of residence, you may place an order only with the involvement or permission of a parent or legal guardian where required by law.

We may suspend or restrict access to an account if we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.


SECTION 2 — OUR PRODUCTS

JustTheCardGuy sells greeting cards and related products, including standard and personalised designs.

We make reasonable efforts to display and describe our products as accurately as possible. However, colours and appearance may vary slightly depending on your screen, device settings, lighting and other technical factors.

Minor variations resulting from printing, cutting, folding or other normal production processes may occur, provided that the product continues to conform to the description and quality that you may reasonably expect.

Product photographs, mock-ups and lifestyle images may be used to present a design or illustrate how a product is used. The individual product page describes what is included with your purchase.

We may update product descriptions, designs, specifications or availability from time to time.

Nothing in this section affects your statutory rights if a product is defective, damaged, incorrectly supplied or does not conform to the agreement.


SECTION 3 — PERSONALISED PRODUCTS

Certain products can be personalised with information supplied by the customer, such as a recipient name, sender name, personal message or other custom content.

You are responsible for checking the spelling, wording and other personalisation information you submit before placing your order.

We will produce personalised products based on the information supplied by you. We are not responsible for errors that are present in the personalisation information submitted by the customer, unless we have agreed to correct or modify that information.

We reserve the right to refuse personalisation requests containing content that is unlawful, threatening, discriminatory, defamatory, infringing or otherwise inappropriate.

Where permitted by applicable law, products made to the consumer's specifications or clearly personalised may be excluded from the statutory right of withdrawal. Further details are provided in our Refund Policy.

A standard card is not considered personalised solely because it is printed after an order is placed.


SECTION 4 — ORDERS AND FORMATION OF THE CONTRACT

When you submit an order, you make an offer to purchase the products included in that order.

After placing an order, you will normally receive an electronic confirmation. An automatically generated acknowledgement does not necessarily mean that we have accepted the order.

A binding purchase agreement is formed once we have accepted the order and/or begun processing it, subject to applicable law.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including:

  • suspected fraud or unauthorised payment;

  • an obvious pricing or product information error;

  • inability to fulfil the order;

  • unlawful or inappropriate personalisation requests;

  • misuse of promotions or discount codes; or

  • an order that would breach applicable law.

If we cancel an order after payment has been received, we will refund the relevant amount using the original payment method.

Please review your order carefully before submitting it, particularly any personalisation details and delivery address.

If you notice an error after ordering, contact us as soon as possible at info@justthecardguy.com. We will try to help, but changes cannot be guaranteed once production or fulfilment has started.


SECTION 5 — PRICES, TAXES AND PAYMENT

The price applicable to your order is the price displayed during checkout when the order is placed.

Any applicable taxes, delivery charges and other charges collected by us will be shown before you complete your purchase.

For international orders, additional customs duties, import taxes or handling charges may be imposed by the destination country. Where these charges are not collected by us during checkout, they may be payable separately by the recipient.

You are responsible for providing accurate billing and payment information.

Payment must be made using one of the payment methods offered during checkout.

We may correct obvious pricing or administrative errors. If an obvious error affects an order you have already placed, we will contact you and, where appropriate, give you the choice of continuing with the corrected information or cancelling the order for a refund.


SECTION 6 — SHIPPING AND DELIVERY

Available delivery methods, shipping costs and estimated delivery times are described during checkout and/or in our Shipping Policy.

Delivery times are estimates unless a specific delivery date has expressly been agreed.

We are not responsible for delays caused by circumstances outside our reasonable control, such as postal disruption, customs processing, severe weather or other external events. This does not affect any mandatory rights you may have in relation to delayed delivery.

For consumer purchases, the risk of loss or damage remains with us until the goods are physically received by you or by a third party designated by you, except where applicable law provides otherwise, such as when you independently appoint a carrier that was not offered by us.

Please ensure that the delivery address you provide is complete and accurate.

If an order is returned to us because of an incorrect or incomplete address supplied by the customer, refusal of delivery or failure to collect the shipment, we may ask you to pay reasonable additional shipping costs before the order is sent again, where permitted by law.


SECTION 7 — RETURNS, WITHDRAWAL AND REFUNDS

Consumers may have a statutory right to withdraw from an eligible distance purchase.

Where the EU or another applicable jurisdiction provides a statutory 14-day right of withdrawal, the withdrawal period for eligible goods generally begins when the goods are received.

Certain goods, including goods made to the consumer's specifications or clearly personalised, may be excluded from this right where the statutory exception applies.

Nothing in our Refund Policy or these Terms affects your statutory rights relating to defective, damaged, incorrect or non-conforming products.


SECTION 8 — DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS

If a product arrives damaged, defective, incorrect or otherwise does not conform to the agreement, please contact us at info@justthecardguy.com.

Where possible, include:

  • your order number;

  • a description of the issue; and

  • clear photographs showing the problem.

Depending on the circumstances and your statutory rights, an appropriate remedy may include replacement, repair, price reduction or refund.

Where we are legally responsible for a defective, damaged or incorrectly supplied product, reasonable return costs will be borne by us.

Your statutory guarantee and conformity rights are not restricted by these Terms.


SECTION 9 — INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content, including JustTheCardGuy branding, original card designs, illustrations, written stories, product copy, graphics, photographs, videos, logos and website design, are owned by or licensed to JustTheCardGuy and are protected by applicable intellectual property laws.

You may use the website and purchased physical products for normal personal, non-commercial purposes.

Unless expressly permitted by us or by applicable law, you may not:

  • reproduce or commercially exploit our website content;

  • copy or reproduce our original card designs for resale;

  • distribute digital copies of our designs or written content;

  • remove copyright or proprietary notices;

  • falsely claim our work as your own; or

  • use our trademarks, trade names or branding in a way that suggests an affiliation or endorsement that does not exist.

Third-party names, trademarks, designs and other intellectual property appearing on our website remain the property of their respective owners.

Nothing in these Terms transfers ownership of intellectual property rights to you.


SECTION 10 — OPTIONAL THIRD-PARTY TOOLS

Our website may provide access to services, applications or tools supplied by third parties.

Those third-party services may be subject to separate terms and privacy policies.

To the extent permitted by law, we are not responsible for the operation or availability of third-party services that are outside our reasonable control.

You should review the relevant third-party terms before using such services.


SECTION 11 — THIRD-PARTY LINKS

Our website may contain links to third-party websites or services.

A link does not necessarily mean that we endorse, control or accept responsibility for the content, products or practices of that third party.

If you choose to visit or purchase from a third-party website, your interaction with that party is subject to its own terms and policies.

Nothing in this section excludes liability where such liability cannot legally be excluded.


SECTION 12 — RELATIONSHIP WITH SHOPIFY

JustTheCardGuy is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are made directly between you and JustTheCardGuy.

Shopify is not the seller of the products offered by JustTheCardGuy and is not responsible for fulfilling orders, handling returns or providing the products purchased from us.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages or losses arising directly from products purchased from JustTheCardGuy.

Nothing in this section limits rights or remedies that cannot lawfully be excluded.


SECTION 13 — PRIVACY

Personal information collected through our website is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify processes certain personal information in connection with your use of the store and its platform.

Shopify's own privacy information can be found through Shopify's official privacy documentation.

Please review our Privacy Policy for information about what information we collect, why we process it, who we may share it with, how long it may be retained and the privacy rights available to you.


SECTION 14 — REVIEWS, FEEDBACK AND USER CONTENT

If you voluntarily submit a product review, photograph, comment, suggestion or other content ("User Content"), you confirm that you have the right to submit that material and that doing so does not unlawfully infringe another person's rights.

You grant JustTheCardGuy a non-exclusive, worldwide, royalty-free licence to use, reproduce and display User Content for purposes connected with operating, improving and promoting our business, subject to applicable privacy and consumer law.

We will not knowingly alter a customer review in a manner that misrepresents the customer's opinion.

We reserve the right to refuse or remove User Content that is unlawful, fraudulent, threatening, discriminatory, defamatory, obscene, infringing, contains malicious software or is otherwise prohibited by applicable law.

Submitting a review does not guarantee publication.

Any incentives offered in connection with reviews will be handled in accordance with applicable law.


SECTION 15 — ERRORS, INACCURACIES AND AVAILABILITY

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, pricing, promotions, shipping charges, delivery times or availability.

We may correct errors and update information where reasonably necessary.

If a material error affects an order you have already placed, we will handle the situation fairly and in accordance with applicable consumer law.

We may discontinue products or change product availability at any time.


SECTION 16 — PROHIBITED USES

You may not use our website or Services:

  • for unlawful or fraudulent purposes;

  • to violate applicable laws or regulations;

  • to infringe our intellectual property rights or those of another person;

  • to transmit malicious software, viruses or harmful code;

  • to obtain unauthorised access to our systems;

  • to collect personal information unlawfully;

  • to impersonate another person or organisation;

  • to submit intentionally false or misleading information;

  • to send spam or unsolicited commercial communications through our systems;

  • to interfere with the security or normal operation of our website; or

  • to use automated systems in a manner that materially disrupts, overloads or circumvents technical restrictions of our Services.

We may take reasonable measures to prevent abusive, unlawful or harmful use of our Services.


SECTION 17 — AUTOMATED SYSTEMS AND AGENTS

Automated or semi-autonomous software that accesses our Services must comply with applicable law and must not circumvent security controls, access restrictions, CAPTCHAs, rate limits or other technical measures intended to protect our Services.

We may restrict automated access where reasonably necessary to protect our website, customers, intellectual property or infrastructure.

Nothing in this section prohibits activities that we cannot lawfully restrict.


SECTION 18 — SUSPENSION AND TERMINATION

We may suspend or terminate access to our website or customer accounts where reasonably necessary, including in response to fraud, unlawful conduct, security threats or material breaches of these Terms.

Termination does not affect rights and obligations that arose before termination, including outstanding payment obligations, refunds or statutory consumer rights.

Provisions that by their nature should survive termination will remain effective.


SECTION 19 — WARRANTIES AND STATUTORY RIGHTS

We aim to ensure that our Services are reasonably accurate, secure and available, but we cannot guarantee that the website will operate continuously or without technical interruptions.

Website content of a general informational nature is provided without guaranteeing that it will be suitable for every individual purpose.

Nothing in these Terms excludes or restricts any statutory guarantee, conformity right or other mandatory consumer protection that applies to your purchase.

Products purchased by consumers must meet the standards required by applicable law, including conformity with the description and the quality that a consumer may reasonably expect.

Any disclaimer in these Terms applies only to the extent permitted by law.


SECTION 20 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

  • fraud or fraudulent misrepresentation;

  • intentional misconduct;

  • liability that cannot be excluded under mandatory consumer law;

  • statutory product liability where applicable; or

  • any other liability that applicable law does not permit us to exclude.

To the extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into.

If you are purchasing as a consumer, nothing in this section affects your mandatory statutory rights.


SECTION 21 — INDEMNIFICATION

To the extent permitted by applicable law, you are responsible for losses reasonably incurred by us as a direct result of your intentional unlawful use of the Services or a material breach of these Terms.

This section does not impose liability on a consumer beyond what is permitted under applicable law.


SECTION 22 — FORCE MAJEURE

We are not responsible for a failure or delay in performing an obligation where this is caused by circumstances outside our reasonable control.

Such circumstances may include severe weather, natural disasters, war, civil disturbance, governmental action, strikes, significant transport disruption, postal disruption, telecommunications failure or other comparable events.

We will take reasonable steps to minimise the effects of such circumstances.

Your statutory rights, including rights relating to non-delivery or delayed delivery, remain unaffected.


SECTION 23 — SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent permitted by law.

The remaining provisions will continue to apply.


SECTION 24 — NO WAIVER

If we do not immediately exercise a right or remedy available to us under these Terms or applicable law, this does not mean that we waive that right or remedy.


SECTION 25 — ENTIRE AGREEMENT

These Terms, together with the policies and information expressly incorporated into them, form the agreement governing your use of our Services and purchases from JustTheCardGuy.

Mandatory rights arising under applicable law remain unaffected.


SECTION 26 — ASSIGNMENT

You may not transfer your contractual rights or obligations to another person where such transfer would materially affect our rights, except with our consent or where applicable law gives you that right.

We may transfer our rights or obligations as part of a lawful transfer, restructuring or sale of our business, provided that doing so does not reduce mandatory rights available to you as a consumer.


SECTION 27 — GOVERNING LAW AND DISPUTES

These Terms and contracts concluded with JustTheCardGuy are governed by Dutch law.

If you are a consumer living in another country, this choice of Dutch law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of habitual residence where applicable.

We encourage you to contact us first if you have a complaint so that we can attempt to resolve the issue directly.

If a dispute cannot be resolved amicably, the competent courts will be determined in accordance with applicable law.

Nothing in these Terms restricts a consumer's right to bring proceedings before a court that has jurisdiction under mandatory consumer-protection rules.


SECTION 28 — CHANGES TO THESE TERMS

We may update these Terms from time to time, for example because of changes to our Services, business practices or applicable law.

The current version will be published on this page with an updated revision date.

Changes will not retroactively alter contracts already concluded unless permitted or required by law.

Where applicable law requires notice or consent for a change, we will comply with those requirements.
